- ApnaChowk kaam karne walon aur kaam dene walon ko jodta hai. Hum kaam dene wale nahin hain, aur aap jo kaam tay karte hain usmein hum party nahin hain.
- Aapki umar kam se kam 18 saal honi chahiye, aur aapki di hui jaankari sahi honi chahiye.
- Kaam, mazdoori aur kaam ka payment kaam karne wale aur kaam dene wale aapas mein seedhe tay aur chukta karte hain. Woh paisa hamare paas se nahin guzarta.
- Aap jo credits aur boost khareedte hain, unka payment humein hota hai. Kharid ke 48 ghante ke andar refund maanga ja sakta hai; kharch ho chuke credits aur chal rahe boost ka refund nahin hota.

Company technology-driven solutions ka use karti hai, jismein location-based services aur automated systems shaamil hain, taaki kaam karne walon aur employers ke efficient matching ko facilitate kiya ja sake, bookings manage ki ja sakein, Platform security behtar ki ja sake, aur overall user experience ko badhaya ja sake. Users Platform par di jaane wali Services ka laabh uthane ke uddeshya se jaankari upload ya provide kar sakte hain, jismein profile details, contact information, job-related information, location data, photos, aur anya relevant information shaamil hai.
Platform ko access ya use karke, aap represent aur warrant karte hain ki:
- Aap kam se kam 18 saal ke hain aur applicable law ke tehat ek binding contract mein enter karne ke liye legally competent hain
- Aapke dwara di gayi saari jaankari sach, accurate, complete, aur up to date rakhi gayi hai
- Aap Platform ka use sirf lawful purposes ke liye aur in Terms va saare applicable laws ke compliance mein karenge
- Agar aap kisi organisation ya business ki or se Platform ko access ya use karte hain, to aap aise organisation ya business ko in Terms se bandhne ke liye vidhivat authorized hain.
Agar Company ko uchit roop se yeh vishwaas hota hai ki uprokt mein se koi bhi representation jhootha hai ya uska breach hua hai, to Company ko Platform tak aapki access ko suspend ya terminate karne ka adhikaar hai.
Platform ke use mein nimnlikhit purposes ke liye Personal Data ka collection aur processing shaamil hai:
- Account registration aur verification
- Kaam karne wale aur employer ki profiles banana aur manage karna
- Job postings, kaam karne walon aur employers ke matching, bookings, aur related Services ko facilitate karna
- Customer support, Platform security, aur service improvement provide karna.
Personal Data ki saari processing Privacy Policy dwara govern hoti hai, jo in Terms ka integral hissa hai.
Company sirf ek intermediary technology Platform ke roop mein kaam karti hai. Jahaan Users apni jaankari swechha se Platform ke madhyam se anya Users ke saath share karte hain, wahaan aisa share karna unke apne vivek par hai, aur Company Platform ke bahar ya apne control se pare aisi jaankari ki kisi bhi processing ke liye zimmedaar nahi hogi.
Company Personal Data ko sirf legitimate purposes ke liye process karti hai, jismein Services provide karna, kaam karne walon aur employers ke matching ko facilitate karna, bookings manage karna, Platform security banaye rakhna, fraud rokna, aur applicable laws ka compliance karna shaamil hai.
Platform ke madhyam se Personal Data submit karke, aap Company ko sirf Services provide karne ke uddeshya se aise data ko process karne ka ek limited, non-exclusive licence dete hain. Personal Data sirf utne time tak retain kiya jayega jitna un purposes ko poora karne ke liye zaroori hai jinke liye ise collect kiya gaya tha, ya jitna applicable law dwara zaroori hai.
Aap represent aur warrant karte hain ki aapke dwara submit ki gayi koi bhi jaankari ya content accurate hai, lawfully obtain ki gayi hai, aur kisi third party ke rights ka ullanghan nahi karti.
Jo Users kaam karne walon, employers, ya businesses ke roop mein Platform ko access ya use karna chahte hain, unhe ek valid account register aur maintain karna hoga aur in Terms va saare applicable laws ka compliance karna hoga.
- Users represent aur warrant karte hain ki registration ke dauraan aur Platform ka use karte samay di gayi jaankari accurate, complete, aur up to date rakhi gayi hai.

- Users apne account credentials ki confidentiality banaye rakhne ke liye zimmedaar hain aur apne account ke kisi bhi unauthorized use ke baare mein Company ko turant notify karna hoga.
Company ko Platform ke use ki monitoring karne ka adhikaar hai aur woh bina prior notice ke kisi bhi User account ko suspend, restrict, ya terminate kar sakti hai, jahaan use uchit roop se yeh vishwaas ho ki kisi User ne in Terms ka ullanghan kiya hai, jhoothi ya misleading jaankari di hai, fraudulent ya unlawful activities mein lipt raha hai, ya anyatha anya Users ki safety ya Platform ki integrity ke liye risk paida karta hai.
Platform ke kuch features tak pahunchne ke liye Users ko ek account banana aur maintain karna pad sakta hai. Account banakar, aap accurate, complete, aur up-to-date jaankari provide karne aur jab bhi zaroori ho aisi jaankari ko turant update karne ke liye agree karte hain.
Platform authentication ke liye aapke registered mobile number aur ek baar ke password (OTP) ka use karta hai aur password-based login ki zaroorat nahi hoti. Aap apne registered mobile number ki security banaye rakhne ke liye zimmedaar hain, kyunki aapke mobile number aur OTP tak access rakhne wala koi bhi vyakti aapke account tak pahunch sakta hai.
Aap poori tarah se nimnlikhit ke liye zimmedaar hain:

Company sirf ek intermediary technology Platform ke roop mein kaam karti hai jo kaam karne walon, employers, aur anya Users ke beech connections ko facilitate karti hai. In Terms mein kuch bhi Company aur kisi User ke beech koi employment, agency, partnership, joint venture, ya contractor sambandh banane ke roop mein nahi samjha jayega.
Kaam karne wale aur employers independent parties hain aur kisi bhi work arrangement ki terms — jismein kaam ki prakriti, wages, payment, timing, quality, aur performance shaamil hain — par negotiate karne, agree karne, aur unhe poora karne ke liye poori tarah zimmedaar hain. Company Users ke beech kisi bhi engagement, agreement, ya dispute ka endorse, supervise, guarantee, ya zimmedaari nahi leti aur aisi arrangements se utpann kisi bhi claims, losses, ya damages ke liye zimmedaar nahi hogi.
Platform sirf kaam karne walon, employers, aur anya Users ke beech connections ko facilitate karne ke liye provide kiya jaata hai. Company guarantee nahi deti ki kisi job posting se employment milega, ki kisi kaam karne wale ko hire kiya jayega, ya ki koi engagement successfully poora hoga.
Company kisi bhi User, job posting, ya work opportunity ki accuracy, quality, suitability, qualifications, availability, conduct, ya performance ko verify ya guarantee nahi karti. Users anya Users dwara di gayi jaankari ka evaluation aur verification karne aur Platform ke madhyam se facilitate kiye gaye kisi bhi engagement ya transaction ke sambandh mein apne decisions lene ke liye poori tarah zimmedaar hain.
Platform aur uski Services "as is" aur "as available" basis par provide ki jaati hain, bina kisi express ya implied warranties ke, siwaay jitna applicable law ke tehat zaroori ho.
Aap agree karte hain ki Platform ko access ya use karte samay, aap nimnlikhit nahi karenge:
- Koi bhi false, inaccurate, incomplete, ya misleading jaankari provide karna, jismein profile details, job postings, skills, qualifications, work experience, ya business information shaamil hai
- Kisi vyakti ya entity ka roop dhaaran karna, fraudulent accounts banana, ya apni identity ya authority ko galat tareeke se present karna
- Platform, uski systems, networks, ya security features mein interfere karna, unhe disrupt karna, ya un tak unauthorized access praapt karne ka prayaas karna
- Platform ka use kisi bhi unlawful, fraudulent, abusive, deceptive, ya harmful uddeshya ke liye karna, jismein fake job opportunities post karna, Users ko mislead karna, ya aisi activities mein lipt hona shaamil hai jo applicable laws ya anya Users ke rights ka ullanghan karti hain.
Company ko apne vivek se in Terms ke kisi bhi suspected violation ki jaanch karne aur uchit action lene ka adhikaar hai, jismein Platform tak access ko restrict karna ya bina prior notice ke aapke account ko suspend ya terminate karna shaamil hai, jahaan use uchit roop se yeh vishwaas ho ki in Terms ya applicable laws ka ullanghan hua hai.
Platform mein aur usse sambandhit saare intellectual property rights, jismein iska software, design, logos, trademarks, content, graphics, text, databases, aur anya materials shaamil hain, Company ke swamitva mein hain ya use licensed hain aur applicable intellectual property laws ke tehat protected hain.
Aap Company ki prior written consent ke bina Platform ke kisi bhi hisse ki copy, reproduce, modify, distribute, publish, reverse engineer, ya commercially exploit nahi karenge.
Users Platform ke madhyam se upload ya submit ki gayi content aur information ka swamitva banaye rakhte hain. Aisi content submit karke, aap Company ko sirf Platform ko operate, maintain, improve, aur promote karne aur Services provide karne ke uddeshya se aisi content ko host, store, display, reproduce, aur use karne ke liye ek limited, non-exclusive, worldwide, royalty-free licence dete hain.
Platform kaam karne walon aur employers ke beech connections ko facilitate karta hai aur Users ko jobs post karne, opportunities khojne, aur bookings manage karne mein saksham banata hai. Company sirf ek intermediary technology platform ke roop mein kaam karti hai aur Users ke beech kisi bhi employment, service, ya contractual arrangement ka party nahi hai.
Saare job engagements, bookings, payments, wages, work schedules, aur anya terms seedhe kaam karne wale aur employer ke beech tay hote hain. Company kaam karne walon ya job opportunities ki availability, kisi engagement ke successful completion, ya kisi kaam ke performance, quality, safety, ya outcome ki guarantee nahi deti. Tadanusaar, Company Users ke beech kisi bhi arrangement se ya uske sambandh mein utpann kisi bhi cancellations, disputes, non-performance, payment defaults, ya losses ke liye zimmedaar nahi hogi.
ApnaChowk ek technology platform operate karta hai jo kaam chahne wale vyaktiyon aur businesses ("Employers") aur apne skills ya services dene wale vyaktiyon ("Kaam Karne Wale") ke beech connections ko facilitate karta hai. ApnaChowk na employer, contractor, ya staffing agency hai, aur na hi platform ke madhyam se bani kisi work arrangement ka party hai. Kisi bhi engagement ki saari terms — jismein scope, wages, timing, aur kaam ki conditions shaamil hain — seedhe Kaam Karne Wale aur Employer ke beech tay hoti hain. ApnaChowk kiye gaye kisi bhi kaam ko supervise, direct, ya control nahi karta.
ApnaChowk safety tools, guidance, aur trust signals provide karta hai, lekin kisi worksite ki safety, kisi kaam ki quality, ya kisi Kaam Karne Wale ya Employer ke conduct ki guarantee na deta hai aur na hi de sakta hai. Safe aur lawful working relationship ki zimmedari Kaam Karne Wale aur Employer ki hai.
ApnaChowk filhaal kisi bhi prakaar ki booking protection ya insurance offer nahi karta. Platform ke zariye ki gayi kisi bhi booking ke liye koi cover lagoo nahi hai, koi protection fee nahi li jaati, aur koi insurer appoint nahi kiya gaya hai. ApnaChowk insurer nahi hai aur insurance ke provision, sale, ya distribution ke business mein nahi hai. Agar future mein booking protection offer ki jaati hai, toh wo poori tarah se ek licensed third-party insurer dwara provide aur underwrite ki jaayegi, aur har tarah se us insurer ki policy terms, conditions, aur exclusions ke adheen hogi. ApnaChowk claims ka payment nahi karega aur kisi bhi claim decision ke liye koi liability accept nahi karta.
Agar future mein booking protection offer ki jaati hai aur aap aisi booking accept karte hain jis par wo lagoo hoti hai, toh aap ApnaChowk ko us cover ki vyavastha aur administration ke liye zaroori seemit personal data, sirf usi uddeshya se, Privacy Policy aur applicable data-protection law ke anusaar, licensed insurer ke saath share karne ki consent de rahe honge.
Yeh maamla kahan khada hai, iski plain-language vyakhya ke liye, Kaam Karne Walon Ki Suraksha Niti aur Booking Protection & Insurance pages dekhein, jinhe in Terms ke saath padha jaana chahiye.
Platform kuch features ke liye credits ka use karta hai, jismein Platform ke madhyam se seedhe communicate karne ke uddeshya se kisi anya User ke contact details ko reveal karna shaamil hai. Credits free grants ke roop mein bhi diye jaate hain aur paid credit packs ke roop mein bhi, jo teen sizes mein available hain: 20 credits ₹99 mein, 50 credits ₹199 mein, aur 100 credits ₹349 mein. Platform par saari keematein Indian Rupees mein batayi jaati hain.
Company kaam karne walon aur employers ke beech kisi bhi kaam, services, wages, ya anya arrangements se sambandhit payments ko collect, receive, hold, process, ya facilitate nahi karti. Kiye gaye kaam ke liye saare payments seedhe kaam karne wale aur employer ke beech Platform ke bahar negotiate aur settle kiye jaate hain, aur Company aise transactions ka party nahi hai.
Company paid visibility features bhi deti hai, jinhe boost kaha jaata hai. Employer apni job posting ko boost kar sakta hai taaki woh ek tay avadhi tak sambandhit listings mein upar dikhe — 3 din ke liye ₹49, 7 din ke liye ₹99, ya 30 din ke liye ₹299. Kaam karne wala isi tarah apni profile ko 7 din ke liye ₹99 mein feature kar sakta hai. Boost sirf posting ya profile ki jagah aur prominence par asar daalta hai; yeh applications, bookings, ya kisi anya parinaam ki guarantee nahi deta.
Company kisi bhi samay paid features chaalu ya band kar sakti hai, jismein kisi payment provider ke saath setup poora hone tak ki avadhi bhi shaamil hai, aur products jod ya hata sakti hai ya keematein badal sakti hai. Jahaan purchase available nahi hai, wahaan Platform usi jagah yeh bata deta hai jahaan purchase ki jaati, aur koi order nahi banta aur koi raashi nahi li jaati. Ye Terms batati hain ki kya diya jaata hai aur kin sharton par; koi khaas purchase kisi samay poori ho sakti hai ya nahi, yeh Platform par hi dikhaya jaata hai.
Kaam karne wale aur employers kisi bhi samay Platform ke madhyam se ek booking cancel kar sakte hain. Ek booking sirf Users ke beech ek intended engagement ka record hai aur Company ke saath koi binding contract nahi banati.
Purchase ke 48 ghante ke bheetar refund ka request kiya ja sakta hai. Jahaan request valid hai, wahaan purchase ki poori raashi lautayi jaati hai, aur refund 7 se 10 working days ke bheetar usi payment method par kiya jaata hai jisse purchase ki gayi thi. Jo credits kharch ho chuke hain woh refundable nahi hain; jo credits us avadhi ke bheetar request karte samay bina kharch ke bache hain woh refundable hain. Payment settle hote hi boost kaam karna shuru kar deta hai, isliye khareedne ke baad woh refundable nahi hai, siwaay us sthiti ke jahaan woh chala hi nahi — job khatam ho chuki thi ya hata li gayi thi, ya Company ki taraf se fulfilment vifal rahi — aisi sthiti mein poori raashi lautayi jaati hai. Purchase usi account ke liye hoti hai jisne woh ki thi aur transferable nahi hai.
Refund ka request karne ke liye, account par darj email address se ya us par darj mobile number ke saath hello@apnachowk.com par likhein, aur purchase ki taareekh tatha raashi batayein. Users Platform ke madhyam se access ki gayi kisi bhi non-public, proprietary, ya sensitive information ki confidentiality banaye rakhne ke liye agree karte hain, jismein anya Users se sambandhit Personal Data, contact details, profile information, job postings, communications, aur booking details shaamil hain. Aisi information ko kisi third party ke saath disclose, reproduce, ya share nahi kiya jayega, siwaay jahaan sambandhit User dwara authorized ho, Platform ke intended use ke liye zaroori ho, ya applicable law ke tehat ya kisi competent authority dwara zaroori ho.
Company apne vivek se aur bina prior notice ke, nimnlikhit ki sthiti mein Platform tak aapki access ko poorn ya aanshik roop se suspend, restrict, ya terminate kar sakti hai:
- In Terms ya applicable laws ka koi breach
- Kisi legal, regulatory, ya governmental requirement ya order ka compliance;
- Jhoothi ya misleading jaankari submit karna, fraudulent activity, Platform ka misuse, ya koi aisa conduct jo Company ki uchit raay mein, Platform, uske Users, ya uske operations ke liye risk paida karta hai.
Users kisi bhi samay Platform ka use band kar sakte hain ya apna account delete kar sakte hain. Halaanki, in Terms ke koi bhi rights, obligations, liabilities, ya provisions jo apni prakriti se survive karne ke liye hain, jismein payments, intellectual property, confidentiality, limitation of liability, aur dispute resolution se sambandhit shaamil hain, aise suspension, termination, ya discontinuation ke bawajood prabhaavi bane rahenge.
Users kisi bhi job posting, profile, booking, communication, ya anya content ki report kar sakte hain jiske baare mein unhe vishwaas hai ki woh in Terms, applicable law, ya kisi vyakti ke rights ka ullanghan karti hai. Company aisi reports ki jaanch kar sakti hai aur, jahaan use uchit roop se yeh vishwaas ho ki koi violation hua hai, content ko remove ya restrict kar sakti hai, warnings jaari kar sakti hai, User accounts ko suspend ya terminate kar sakti hai, ya Platform aur uske Users ki suraksha ke liye koi anya action le sakti hai jise woh uchit samjhe. Report karne ke liye, mobile app mein kisi job ya profile par Report ka use karein, jahaan aap kisi vyakti ko block bhi kar sakte hain, ya Grievance Officer ko hello@apnachowk.com par likhein.
Company aisi action tab bhi le sakti hai jab law, kisi competent jurisdiction ki court, ya kisi governmental ya regulatory authority dwara zaroori ho.
Applicable law ke tehat anumat poorn seema tak, Company kisi bhi direct, indirect, incidental, consequential, special, ya punitive damages ke liye, ya Users ke beech kisi bhi interaction, booking, work arrangement, ya engagement se ya uske sambandh mein utpann kisi bhi loss, injury, dispute, non-performance, payment default, ya anya claim ke liye zimmedaar nahi hogi. In Terms mein kuch bhi aisi kisi liability ko exclude ya limit nahi karta jise applicable law ke tehat exclude ya limit nahi kiya ja sakta.
Applicable law dwara anumat adhiktam seema tak, ApnaChowk platform ke madhyam se bani kisi bhi work arrangement ya kisi user ke conduct se ya uske sambandh mein utpann kisi bhi loss, injury, damage, ya dispute ke liye liable nahi hoga.
Platform aur saari content, features, aur Services "as is" aur "as available" basis par provide ki jaati hain, bina kisi warranties ke, chahe express ho ya implied.
Applicable law ke tehat anumat maximum seema tak, Company saari warranties ka disclaimer karti hai, jismein accuracy, reliability, availability, merchantability, kisi particular purpose ke liye fitness, aur non-infringement se sambandhit shaamil hain. Vishesh roop se, Company warrant nahi karti ki:
- Platform uninterrupted, secure, ya error-free roop se operate hoga
- Users dwara di gayi koi bhi job posting, profile, ya information accurate, complete, reliable, ya current hogi; ya
- Kisi kaam karne wale ko hire kiya jayega, koi employer kisi kaam karne wale ko engage karega, ya koi booking ya work arrangement successfully poori hogi ya koi particular outcome degi.
Company sirf ek intermediary technology platform ke roop mein kaam karti hai aur Platform ke madhyam se facilitate kiye gaye kisi bhi User ya kisi engagement ke conduct, performance, quality, safety, ya suitability ki guarantee nahi deti.
Users dwara Platform ya Services ke sambandh mein submit ki gayi koi bhi feedback, suggestions, ideas, ya recommendations voluntary aur non-confidential hain. Aisi feedback provide karke, aap Company ko Platform aur uski Services ko behtar banane ke liye aisi feedback ka use, reproduce, modify, aur incorporate karne ke liye ek non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence dete hain, bina kisi compensation ya attribution ke obligation ke.
Aap Company, uske directors, officers, employees, affiliates, aur service providers ko nimnlikhit se ya uske sambandh mein utpann kisi bhi claims, losses, liabilities, damages, costs, ya expenses (reasonable legal fees sahit) se indemnify, defend, aur hold harmless karne ke liye agree karte hain:
- Platform ya Services ka aapka misuse;
- In Terms ya kisi applicable law ka aapka breach;
- Kisi third party ke rights ka aapka violation, jismein intellectual property, privacy, confidentiality, ya anya legal rights shaamil hain; ya
- Aapke aur kisi anya User ke beech kisi arrangement ya engagement se utpann koi dispute, claim, ya liability.
Yeh obligation Platform ke aapke use ki termination ke baad bhi bana rahega.
